Surveillance in the workplace

From February 2018, the Surveillance Devices Act 2016 (SA) (the Act) is set to commence operating in relation to businesses in South Australia.

The Act replaces the current Listening and Surveillance Devices Act 1972 (SA) and prohibits the use of optical, audio, tracking or data surveillance devices without the express or implied consent of the persons being surveilled.

For businesses, this means that you will now be required to notify your employees of any surveillance activity which may be used within the business. Ideally employees should sign off on a policy regarding this surveillance, however it is sufficient that employees are notified.
